Heard learned counsel for the petitioner and learned Standing Counsel for the State-respondents.
The present petition has been filed by the petitioner alleging that an order of termination was passed by the Committee of Management against the respondent no. 4 and letter was sent for approval in terms of the provisions of U.P. Secondary Education Services & Commission (Procedure for Approval of Punishment) Regulations, 1985. It is argued that the proposal was sent for approval on 23.12.2019, which was sent back with some objections on 20th September, 2020. It is claimed that after removing the defects, as pointed out, the matter was once again sent on 17.3.2020, however, the respondent no. 3 is sitting over the matter despite the Act mandating a decision ordinarily within 30 days.
Considering the fact that the proposal is pending consideration before the respondent no. 3, the present petition is disposed off with a direction upon the respondent no. 3 to take action by passing speaking order, in accordance with law, on the proposal sent by the petitioner on 17.3.2020, as expeditiously as possible, preferably within a period of two months from the of production of a copy of this order before the respondent no. 3.
The writ petition is disposed off in terms of the said order.
