Heard learned counsel for the parties.
The present writ petition has been preferred with a request directing the respondent no. 4/ U.P. Secondary Education Service Selection Board, Prayagraj to take a decision on the papers relating to termination of services of Sri Pramod Kumar.
At the very outset, Sri Alok Dwivedi who appears for Pramod Kumar (Officiating Principal) raised two-fold objections regarding maintainability of the writ petition. Firstly without impleading Pramod Kumar (Officiating Principal), no such direction can be issued as has been prayed for. Secondly, the term of Committee of Management has expired. The Joint Director of Education, Kanpur Region, Kanpur has already appointed Authorised Controller by the order dated 12.1.2021, as such, no relief can be accorded to the petitioner.
Confronted with this situation, Sri Rajan Upadhyay, learned counsel for the petitioner very fairly states that he is not pressing the writ petition at this stage. However, leave may be accorded in case the petitioner is aggrieved by the order dated 12.1.2021, he can challenge the same before the appropriate Forum.
Consequently, the writ petition stands dismissed as not pressed. Suffice to indicate, it is always open to the petitioner to challenge the order dated 12.1.2021, in case, the term of the petitioner still subsists.
