Heard learned counsel for the petitioner; learned Additional Chief Standing Counsel for the State respondents and Shri Yatindra, Advocate for the second and third respondents.
With the consent of learned counsel for the parties, the writ petition is being disposed of at this stage without calling for a counter affidavit.
Committee of Management Shri Mukandy Singh Bal Vidalay Kharikvary Danpur, Bulandshahar is before this Court seeking a direction upon the respondents to pay the salary to staff of petitioner's school from grant-in-aid paid by the State Government after taking the Vidyalaya in the list of grant-in-aid w.e.f. 02.09.2014 in view of the law laid down by this Court in Special Appeal no.994 of 2014 (Paripurna Nand Tripathi and another vs. State of U.P. and others).
Considering that the claim of the petitioner can be examined by the respondents in the light of the decision of this Court, after verifying the facts as well as applicability of law on the facts of the case, no useful purpose would be served in keeping the matter pending, therefore, with the consent of learned counsel for the parties, the petition is being finally disposed of.
The writ petition is, therefore, disposed of with a direction to respondent no.1, Secretary, Basic Education, Government of U.P. Lucknow to consider and decide the claim of the petitioner, in accordance with law, within a period of three months from the date a certified copy of this order is received in his office.
