Civil Misc. Delay Condonation Application No. 150700 of 2017 Heard Sri Anil Kumar Srivastava, learned counsel for the applicant/petitioner.
Cause shown is good and sufficient. Application is allowed.
Delay in filing the restoration application is condoned.
In Re: Civil Misc. Restoration Application No. 150702 of 2017 The instant application has been filed to recall the order dated 02.09.2016, recalling the order dated 27.03.2014, thereby, restoring the case to its original number, contending that the earlier application was filed by an imposter, who is not the manager of the Committee of Management.
The learned counsel for the applicant representing the first petitioner i.e. Committee of Management of the institution submits that applicant, Lalta Prasad is the Manager of the Committee of Management and not Sri Dinesh Kumar Yadav. The applicant in the capacity of the Manager of the Committee of Management does not desire to press the petition.
The application is allowed.
Order dated 02.09.2016 is recalled.
The writ petition would stand dismissed as withdrawn in view of the order dated 27.03.2014.
Interim order, if any, stands vacated.
