Heard Sri N.A. Khan, learned counsel for the petitioners, learned Standing Counsel for respondent Nos. 1 and 2.
Considering the nature of order proposed to be passed there is no need to issue notice to respondent No. 3.
Learned counsel for the petitioners submitted at the bar that he does not want to press the first prayer that is for quashing of order dated 14.03.2019.
Learned counsel for the petitioners submitted that there is an educational institution in the name of Mahagaon Inter College, Kaushambi and the petitioner is the Manager of the said Institution. It is further submitted that there is some dispute with regard to election of Committee of Management and ultimately vide order dated 14.03.2019, order of single operation was passed. He further submitted that he has moved an application dated 12.04.2019 after election of new Committee of Management before the respondent No. 2-D.I.O.S. Kaushambi, but the same has not been decided till date. Lastly, it is submitted that a suitable direction may be issued to the respondent no. 2 to decide the application of the petitioners.
Learned standing counsel has submitted that he has no objection to the prayer made by the learned counsel for the petitioners.
Considering the facts and circumstances of the case, this petition is disposed of with a direction to the respondent no. 2 to decide the application of the petitioners dated 12.04.2019 strictly in accordance with law after providing opportunity of hearing to respondent no. 3, namely Tarique Salman and any other person likely to be affected, within a period of two months from the date of production of certified copy of this order.
It is made clear that the Court has not adjudicated the matter on merits. It is upon the respondent no. 2 to decide the application of the petitioners after considering the facts of the case as well as law occupying the field.
