The petitioners claim that a representation was made to the respondent No.1- Principal Secretary/Additional Chief Secretary, Minority Welfare, U.P. at Lucknow for bringing the institution under grant in aid of the State Government.
The only prayer made by Sri Hritudhwaj Pratap Sahi, learned counsel for the petitioners is that the representation may be decided within a stipulated period of time.
Learned Standing Counsel submits that the representation regarding grant in aid will be processed under the government orders holding the field after verification of the relevant facts by the competent authority.
In light of the submissions made by the learned counsel for the parties, no useful purpose will be served by keeping the petition pending.
The matter is remitted to the respondent No.1-Principal Secretary/Additional Chief Secretary, Minority Welfare, U.P. at Lucknow.
A writ of mandamus is issued commanding the respondent No.1-Principal Secretary/Additional Chief Secretary, Minority Welfare, U.P. at Lucknow, to execute the following directions:
1. The respondent No.1-Principal Secretary/Additional Chief Secretary, Minority Welfare, U.P. at Lucknow, shall decide the representation of the petitioners for bringing the institution under the grant in aid of the State Government within a period of four months from the date of receipt of a certified copy of this order along with a fresh copy of the representation and relevant testimonials.
2. In case there is some infirmity/deficiency in the application, the petitioners shall be noticed and given an opportunity to cure the deficiencies.
3. The representation shall be decided by a reasoned and speaking order in accordance with law.
The writ petition is finally disposed off.
