The instant petition is directed against the order dated 25.4.2018, whereby the District Magistrate, Varanasi has rejected the transfer application filed by respondent no.4 for transferring proceedings pending before the Prescribed Authority under Section 25(1) of the Societies Registration Act, 1860 on the ground that the application has been rendered infructuous, as the Prescribed Authority, against whom allegations were made in transfer application, has since been transferred.
Learned counsel for respondent no.4 informs the Court that Sri Sanjeev Kumar has now been posted as Sub Divisional Magistrate (Sadar). He is competent to act as Prescribed Authority. Thus, according to him, there is no hindrance in the way of newly posted Prescribed Authority to decide the matter.
Having regard to these facts, the instant writ petition is disposed of by providing that the officer who has now assumed charge on the post of Prescribed Authority, shall proceed to decide the reference, in accordance with law, preferably within a period of six weeks from the date of production of a certified copy of this order.
