Heard learned counsel for the applicant.
By the instant petition, petitioners are assailing the notice dated 11.02.2021 passed by the third respondent, Prescribed Authority/Sub Divisional Magistrate, Dadri, District Gautam Budh Nagar, under the provisions of U.P. Public Premises (Eviction of Unauthorized Occupants) Act 1972.
Learned Standing Counsel, at the outset, submits that the petition would not lie against a notice to show cause.
This fact is not being disputed by leaned counsel for the petitioners.
In view thereof, the writ petition is disposed of as withdrawn with liberty to the petitioners to file objection supported by documents. In the event, such objection is filed within 15 days from date, it is expected that the third respondent, Prescribed Authority/Sub Divisional Magistrate, Dadri, District Gautam Budh Nagar, shall consider and decide the notice, expeditiously, by a speaking and reasoned order, after hearing all the aggrieved parties.
