Heard learned counsel for the petitioner, learned Standing Counsel for the State and Sri Arun Kumar, learned counsel for the fifth respondent.
By the instant petition, petitioners are challenging the order dated 15.04.2021 passed by the fourth respondent, Sub Divisional Magistrate, Tehsil Khadda, District Kushi Nagar, whereby, the election held on 20.11.2018 was cancelled and matter was remanded to the Assistant Registrar to decide the dispute on merits.
In view thereof, on consent of the parties, writ petition is disposed of. The Assistant registrar shall comply the order by deciding the electoral college after hearing all the aggrieved parties. On finalization of the list of members, the election shall be conducted as per the bye laws of the society, expeditiously within four months from the date, provided there is no other impediment.
In the mean time, the committee of management already functioning shall continue to manage the affairs of the institution, but shall not take any decision pertaining to finance of the institution of the society pending decision.
