The petitioners claim that being lawfully elected Committee of Management of Edrah Baitul Mehdi Educational Society, District Azamgarh, they had applied for renewal of the registration certificate of the society by filing an application dated 26.12.2017/07.07.2018 but which is not being decided.
The petitioner No. 2 further claims that she was co-opted as Manager in proceedings dated 16.05.2018 after death of erstwhile Manager on 28.04.2018.
After hearing learned Counsel for the parties, this Court is of the opinion that in case an application has been filed seeking renewal of registration certificate, the said application has to be considered and decided, but it cannot be kept pending.
The writ petition is disposed of with direction to respondent No. 2 to take decision on the said application in accordance with law expeditiously, preferably within a period of 12 weeks from the date of receipt of certified copy of the order, after hearing all concerned parties.
