Heard learned counsel for the petitioners, Sri Shiv Sagar Singh, learned counsel for the newly impleaded respondent No.4 and learned Standing counsel.
The present writ petition under Article 226 of the Constitution of India has been filed for issuance of writ of mandamus commanding the respondent No.2 i.e. Assistant Registrar, Firms Societies and Chits Moradabad Region, Sharifnagar, District- Moradabad to dispose of petitioners' pending objection/ representations dated 17.04.2019 and 24.06.2019 respectively.
In paragraph 12 of the affidavit filed in support of the impledment application, it is stated that the respondent No.2 proceeded in the matter on the basis of record on 15.11.2019 and the matter was finally heard between the parties and under the pronouncement of judgment of the respondent No.2. In these circumstances, there is no occasion to issue any direction to the respondent No.2. The said fact has been verified by the learned counsel for the petitioner and till date no judgment for deciding the objection of the petitioners has been pronounced by the Assistant Registrar, Firm Socities and Chits Moradabad Region, Sharifnagar, District Moradabad, ie. respondent No.2.
No useful purpose will be served by keeping the writ petition pending.
Under the facts and circumstances of the present case, the Assistant Registrar, Firms Societies and Chits Moradabad Region, Sharifnagar, District Moradabad is directed to take decision in the matter as expeditiously as possible, preferably within a period of three months from the date of production of a certified copy of this order before him.
Writ Petition is, accordingly, disposed of.
