This writ petition has been filed by the Committee of Management, Maa Gayatri Institute Chandaus, Aligarh seeking a direction to the Director of Social Welfare, Government of U.P., Lucknow to reimburse fees of 30 scheduled caste students who were admitted in the petitioner institution for having the B.Ed Course for the session 2016-17, 2017-18.
It is contended that that scheduled caste students have been admitted without deposit of any fee on the footing of government policy and as per the government policy the fee is liable to be reimbursed by the State Government. The petitioner institution is a self financed institution. The petitioner institution has made a representation to the respondent no.4 for releasing the fee of scheduled caste candidates who have been admitted in the institution.
No useful purpose would be served by keeping this writ petition pending.
The matter is remitted back to respondent no. 4. A mandamus is issued to respondent no. 4 commanding him to consider and decide the application for release of scholarship fee submitted by the petitioner institution in accordance with law.
It is clarified that the respondent no. 4 shall conduct a due diligence exercise and make relevant queries and verify the facts before passing final decision in the matter. The above exercise shall be completed within a period of two months. The respondent no. 4 shall decide the claim of the petitioner regarding reimbursement of fee of scheduled caste students within a period of two months by a reasoned and speaking order.
The writ petition is disposed of.
