Heard Shri Ratnesh Kumar Srivastava holding brief of Shri Madan Lal Srivastava for the petitioners, Shri Ram Bilas Yadav, learned counsel for the respondents no. 2 and 3 and the learned standing counsel for the respondent no. 1.
The petitioners in the writ petition are seeking a direction to the respondents to take the Primary School/Primary Section of the Institution namely M.A.O. Junior High School, Jama Masjid, Agra and Baini Singh Vaidik Junior HIgh School, Baluganj, Agra under the grant in aid in view of the law laid down by the Apex Court in the case of State of U.P. Vs. Pawan Kumar Dwivedi and others and pay the salary to the teachers and other employees of the Institution.
No useful purpose would be served in keeping this writ petition pending.
This writ petition is therefore disposed of with a direction that if the petitioners make an appropriate application raising all their grievances as raised in the present writ petition within 15 days from today alongwith certified copy of this order before the respondent no. 1-Secretary Basic Education, U.P. at Lucknow, the same shall be decided by the respondent no. 1 in accordance with law within a further period of four months.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
