Heard learned counsel for the petitioners and learned Standing Counsel for respondents no.1 & 2.
The petitioner is committee of management of Lalauli Inter College, Lalauli, District Fatehpur which is a minority institution. A post of Lecturer (Maths) came into existence on account of retirement of one Mohd. Tahir Shah on 31.03.2019. The petitioner has submitted application to the respondent no.2 for prior approval for appointment as required under Section 16FF read with Regulation 17 (g) of UP Intermediate Education Act, 1921.
The grievance of the petitioner is that neither the respondent no.2 has considered his representation nor has passed any order for according prior permission.
Learned Standing Counsel submits that no useful purpose would be served in keeping the writ petition pending and appropriate direction may be issued to respondent no.2 to consider the grievance of the petitioner.
Considering the facts and circumstances of the case and without going into the merits of the case and with the consent of the parties, the writ petition is disposed off with liberty to the petitioner to file a fresh representation before the respondent no.2-District Inspector of Schools, Fatehpur, raising all his grievances within a period of two weeks from today. In case any such representation is filed by the petitioner, the respondent no.2 shall consider and decide the same by reasoned and speaking order within a period of two months thereafter.
The writ petition is disposed of subject to the observations made above.
