This writ petition is by the Committee of Management challenging an order of the District Inspector of Schools, Amroha, dated 17th October, 2018, whereby a direction is issued to the Committee of Management to allow the senior most Lecturer to officiate as Principal of the institution. The order is assailed on the ground that the Officiating Principal had indulged in various illegalities in the past and certain audit reports etc. have also been submitted in which he has been implicated. It further appears that petitioner has also represented in the matter before Joint Director of Education, who has directed the District Inspector of Schools to examine the issues that have been highlighted by the Committee of Management in the matter relating to continuance of respondent no.3 as Officiating Principal.
Learned Standing Counsel states that the concerned Inspector shall look into the grievance of petitioner.
In the facts and circumstances, noticed above, this writ petition stands disposed of with a direction upon the respondent no.2 to accord consideration to the issues that have been raised by the petitioner Committee of Management with regard to continuance of respondent no.3 as the Officiating Principal, by passing a reasoned order, in accordance with law, within a period of two months from the date of presentation of certified copy of this order. Needless to say that an opportunity of hearing would be given to respondent no.3 in the matter. The order impugned shall remain subject to the fresh orders to be passed by the Inspector, in that regard.
