The instant writ petition has been filed seeking a mandamus commanding respondent No. 2 - Assistant Registrar, Firm, Societies and Chits, VII Region, Gorakhpur to register the list of office bearers for the year 2017-18 on basis of the application filed in that regard by petitioner No. 2. It is noteworthy that in the list submitted by the petitioners for registration of the office bearers, petitioner No.
2 has been shown as Manager in place of Bhola Prasad, who according to the petitioner died on 18.1.2018 and in whose place petitioner No. 2 came to be elected. It is submitted that no decision has been taken in the matter by the second respondent so far.
Learned counsel for the petitioners submitted that on account of non-registration of the list, the operation of the account of the Institution being run by the Society is being hampered.
Learned standing counsel states that the second respondent will consider the issue relating to registration, within such time as may be directed by this Court.
Accordingly, without expressing any opinion on merits, the writ petition is disposed of by directing the second respondent to take decision in the matter, within a period of eight weeks from the date of production of a certified copy of this order, after due notice and opportunity of hearing to rival claimants, if any.
