By impugned order dated 18.6.2018, the District Inspector of Schools has proceeded to recognise election of the Committee of Management of Kishan Inter College, Tundala, Firozabad held on 10.6.2018 in which Praveen Kumar Sharma was elected as President and Vasudev Sharma as Manager.
Sri H.N. Singh, learned senior counsel appearing on behalf of the petitioners submitted that the Committee which has been recognised owe its existence to a society named Kishan Shiksha Samiti, whereas the actual society which is running the said institution is Kishan Uchchattar Madhyamik Vidyalaya, Alai, Tundala, another registered society. He submitted that the society Kishan Shiksha Samiti got registered by fraud and misrepresentation. He further states that dispute relating to registration of the said society is pending before the Deputy Registrar, in regard whereof there is already a direction by this Court dated 20.3.2018 in Writ-C No.10227 of 2018 to the Deputy Registrar to decide the same within four months. He fairly admits that fate of the impugned order would depend upon the decision which would ultimately be taken by the Deputy Registrar in proceedings under Section 12-D.
In view of the above facts and having regard to the submissions made, the instant writ petition is disposed of by providing that in case proceedings under Section 12-D concludes in favour of the petitioners, it shall be open to them to assail the impugned order before the Regional Level Committee or before such other forum, as may be advised.
