It is stated that a class III post has fallen vacant in the institution concerned, which is required to be filled in terms of the U.P. Recognized Basic Schools (Junior High Schools) (Recruitment and Conditions of Services of Ministerial Staffs and Group 'D' Employees) Rules, 1984. It is contended that petitioner committee has already approached the District Basic Education Officer, Gorakhpur, but despite repeated requests permission has not been granted, nor any nominee has been appointed. Hence, this petition.
Sri Arun Kumar, learned counsel appearing for the District Basic Education Officer, Gorakhpur submits that petitioner's grievance shall be examined, in accordance with law.
In the facts and circumstances, this writ petition stands disposed of with a direction upon the respondent no.1 to accord consideration to petitioner's claim, noticed above, in accordance with law, by means of a reasoned order to be passed, within a period of two months from the date of presentation of certified copy of this order.
