The appellant Satish Chandra, a watchman (chaukidar), was dismissed from his services after having put in 32 years of his service by the Committee of Management of the Institution which is a Junior High School where the services of the employees are governed by the U.P. Recognized Basic Schools (Junior High Schools) (Recruitment and Conditions of Service of Ministerial Staff and Group-D Employees) Rules 1984.
The issue of dispensation of the services of the appellant has been decided by this Bench today through a separate judgment in Special Appeal No. 893 of 2018.
The present appeal has been filed by the Committee of Management assailing the direction of a learned Single Judge under which the District Basic Education Officer has been called upon to decide the representation of Satish Chandra the respondent no.4 herein for payment of his post retiral benefits.
In our considered opinion, once the directions given by us in the Special Appeal No. 893 of 2018 are complied with by the District Basic Education Officer, he may therefore proceed to pass an appropriate order accordingly.
This appeal stands dispose off with the above modification in the impugned judgment dated 21.08.2018.
