Heard learned counsel for the petitioner and the learned Standing Counsel for the State-respondents as well as Sri Sujeet Kumar, who has entered appearance on behalf of the respondent No. 5. Although notice has been received by Sri Daya Ram for the respondent No. 4, none has appeared even when the matter is taken up in the revised call.
Alleging himself to be the President of the Committee of Management, the petitioners have approached this Court for a mandamus being issued commanding the respondents to conclude the enquiry which has been initiated against the respondent No. 5. There exists a private dispute between the petitioners and the respondent No. 5 with both asserting themselves to be the Committee of Management of the institution in question. These disputes by their very nature cannot form subject matter of adjudication under Article 226 of the Constitution.
Writ petition is consequently dismissed.
This order, however, shall not preclude the petitioner from initiating such proceedings as may be chosen and advised, which may be available in law.
