Supplementary affidavit, filed today in the Court, is taken on record.
Heard Sri Ashok Khare, learned Senior Advocate, assisted by Sri J.P. Singh, learned counsel for petitioners, learned Standing Counsel appearing for State-respondents and Sri Vineet Kumar Singh, Advocate, appearing for private respondents no. 7 to 21.
After arguing the matter at length, learned counsel appearing for the private respondents submits that the impugned order dated 09.07.2921 passed by third respondent, District Inspector of Schools, Firozabad pursuant to the direction of this Court dated 21.01.2021 passed in Writ Petition No. 249 of 2021 (Prabhat Kumar and others Vs. State of U.P. and others) be set aside and the third respondent be directed to decide afresh.
In view thereof, on the consent of the learned counsels for the parties, the impugned order dated 09.07.2921 passed by third respondent, District Inspector of Schools, Firozabad is set aside with liberty to third respondent to take a decision afresh.
It is clarified that this order would not mean that petitioner-committee of management has been restrained from functioning as committee of management of the institution.
The writ petition is disposed of in the manner hereinabove.
