Heard learned counsel for the petitioner and learned Standing Counsel.
The petitioner-Committee of Management is before this Court assailing the order dated 08.09.2017 passed by second respondent i.e. Distric Basic Education Officer, Mau by which he has declined to send his nominee for participating in the selection committee constituted for selection of clerk in the institution in question.
The Court has proceeded to examine the record in question and does not find any good ground to interfere in the matter.
Once the Court has declined to interfere in the matter, learned counsel for the petitioner requested that a direction may be issued to the second respondent that in case the management moves a fresh application for according permission within 15 days, the same may be considered so that the post of clerk, which is vacant since 1st March, 2015 may be filled up at the earliest.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the writ petition stands disposed of asking the petitioner management to move fresh application within 15 days and in case any such application is moved, the second respondent will consider the same and pass appropriate order within further two weeks so that proceeding may be finalised for filling up the said post in the institution in question.
