Heard Mr. R. P. Singh, learned counsel for the petitioners. Learned Standing Counsel has accepted notice on behalf of respondents no.1 to 3. Mr. Mrigraj Singh, learned Counsel, has accepted notice on behalf of respondent no.4.
The petitioners have preferred the present writ petition with the prayer to direct the respondent no.4 to accord permission to the petitioner's Committee of Management to fill up the vacancy of 2 Assistant Teachers forthwith taking into consideration the order dated 8.8.2017 passed by the District Basic Education Officer, Jaunpur (annexure no.8 to the writ petition) in which 9 posts of Assistant Teachers is held to be sanctioned.
Learned counsel for the petitioner contended that in order to fill up the vacant post of Assistant Teachers in the institution in question letters were written by the institution to the District Basic Education Officer, Jaunpur vide letter dated 17.4.2018 since no action was taken another letter by way of reminder was submitted by Manager of the institution to the District Basic Education Officer, Jaunpur, on 30.10.2018 through registered post, copy of the same is appended as annexure 10 to the writ petition.
No useful purpose would be served in keeping the writ petition pending hence with the consent of learned counsel for the parties, the writ petition is being disposed of at the admission stage itself.
In the facts and circumstances, the petitioner is directed to make a fresh representation ventillating all his grievances before the respondent no.4/District Basic Education Officer, Jaunpur, along-with certified copy of this order within a period of two weeks from today. If such a representation is made, the respondent no.4/District Basic Education Officer, Jaunpur, is directed to pass appropriate order in accordance with law within a further period of two months.
With the aforesaid observations, present writ petition is disposed of finally.
It is made clear that this Court has not entered into the merits of the case and thus it is for authority concerned to take a decision independently in accordance with law.
Learned counsel for the petitioner is directed to provide copy of this order to Mr. Mrigraj Singh, learned counsel for the respondent no.4.
