It appears that the petitioner - Committee of Management had resolved to remove the respondent no. 4 from service and for obtaining prior approval of the U.P. Secondary Education Services Selection Board, the District Inspector of Schools has forwarded all details to the Secretary of the Board on 25th January, 2017. It is stated that the Secretary of the Board has demanded certain documents on 15.9.2017 and again on 7.4.2018, which have been submitted to the office of District Inspector of Schools, Fatehpur on 7th July, 2017 by the petitioner. Grievance is that, Inspector has not forwarded such materials to the Board, on account of which, a final decision has not been taken.
Learned Standing Counsel states that in case such documents have not been forwarded, the same shall be done forthwith.
In the facts and circumstances, noticed above, this petition stands disposed of permitting the petitioner to represent before the District Inspector of Schools, Fatehpur, alongwith certified copy of this order within two weeks, annexing all documents, which have been furnished in response to the query of the Board. The Inspector shall thereupon forward such papers to the Board within a further period of four weeks. The Board shall thereafter shall pass an appropriate order in terms of Section 21 of the Act, 1982, after affording an opportunity of hearing to respondent no. 4, within a further period of three months.
