Petitioner has made a representation to the Joint Director of Education, Saharanpur Region, Saharanpur to ensure that the election to the Committee of Management are conducted within a stipulated period of time.
Learned Standing Counsel has no serious objection to the aforesaid prayer.
The matter is remitted to the respondent No. 3, Joint Director of Education, Saharanpur Division, Saharanpur.
A writ of mandamus is issued commanding the respondent No. 3, Joint Director of Education, Saharanpur Division, Saharanpur to enquire into the fact whether the elections to the committee of management of the Institution are due or not. In case the elections are due but have not been held, the Joint Director of Education shall pass appropriate orders for conducting the said elections. The Joint Director of Education before passing any order shall hear all necessary parties. The exercise shall be completed, preferably, within a period of four months from the date of receipt of a certified copy of this order.
The Court has not gone into the veracity of the assertions in the writ petition nor has the claim of the petitioner been judged on merits. It is for the competent authority to do so after independent application of mind.
The writ petition is disposed of finally.
