This writ petition has been filed on behalf of the Committee of Management, Janta Rashtriya Vidyalaya, Pipra Kalan, Post Pachkhra, Pargana Kopachit Sharki, Tehsil and District Ballia through Manager Bhrighu Nath Yadav.
It is contended on behalf of the petitioner that he is a rival claimant though he admits that the signatures of 4th respondent have been attested and his Committee of Management is recognized by the authority.
This writ petition questions the very advertisement issued by recognized Committee of Management. However, the argument advanced is that he being rival claimant, can question the advertisement issued by committee of Management may be its Manager's signature has been attested.
In the opinion of the Court, this writ petition is liable to be dismissed firstly on the ground of non joinder of necessary party as Committee of Management has not been impleaded and also for mis-joinder of parties as the petitioner has no right to title itself as a Committee of Management of the institution.
However, it is open for the person concerned, if he is aggrieved, to file an appropriate writ petition, if so advised.
Writ petition is accordingly dismissed.
