Learned counsel for the petitioners submitted that by the order dated 7.9.2011 in Writ Petition No. 51510 of 2011, this Court has directed the District Inspector of Schools, Gorakhpur to determine the electoral college after inviting objection on the same day and thereafter on the basis of determination of electoral college, election of the managing committee be held preferably within two months. In pursuance of the said order, the District Inspector of Schools, Gorakhpur has also sought the membership list from the Assistant Registrar, Firms, Chits and Society, Gorakhpur, which has been provided by him on 23.11.2011, which is Anenxure-16 of the writ petition. He further submitted that though no direction has been given to the Registrar, Firms, Chits and Society, Gorakhpur still the Registrar, Firms, Chits and Society, Gorakhpur vide letter dated 12.12.2011 directed the petitioners and others in pursuance of the order dated 7.9.2011 passed in Writ Petition No. 51510 of 2011 issued notices to Sri Yadunandan Lal, Smt. Malti Devi and Sri Chunni Lal to produce the register and other documents for the finalization of the list while as per the order of this Court, electoral list was to be finalized by the District Inspector of Schools, Gorakhpur and not by the Registrar, Firms, Chits and Society, Gorakhpur. Therefore, the proceeding before the Registrar, Firms, Chits and Society, Gorakhpur, is patently illegal.
