Heard Smt. Sunita Agrawal on behalf of respondents no.2 and 3. Learned Standing Counsel accepted notice on behalf of respondent no.1. All the respondents may file counter affidavit within one month. The petitioners will have two weeks thereafter to file rejoinder affidavit.

The contention raised by the petitioners is that on the basis of permission granted by the University, the students have been admitted and after cancellation of the recognition/affiliation by NCTE, the appeal filed by the petitioners has already been allowed though it is mentioned the session from 2009-10 in the order of 18.2.2010. Petitioners have already challenged the order on the ground that the students who have already been admitted in the B.Ed. classes for the Session 2008-09 and continuing the studies, no decision has been taken in the order dated 18.2.2010 though the dispute was relating to that particular year. The examination is going to be held from 2.7.2010. In such circumstances, I am of opinion that as the career of these students are involved, who have already been permitted to continue their studies on the basis of temporary recognition/permission by the University, their career will be affected in case the writ petition filed by the petitioners is allowed. Therefore, it will be appropriate that the students who have already been admitted for the Sessions 2008-09 may be permitted to appear in the examination by respondent no.3 provisionally after completing the necessary formalities in the said examination.
