Leave granted to learned counsel for the petitioners to correct the description of respondent Nos. 1 & 2 in the cause title.
The petitioners claim that they are running a Primary School in the name of Ideal Harijan Prathmik Vidyalaya, Mittha, Ballia. They are claiming grant-in-aid in accordance with the provisions of the Right of Children to Free and Compulsory Education Act, 2009. Reliance has been placed on a Division Bench judgment of this court in Paripurna Nand Tripathi Versus State of U.P., 2015(3) ADJ 567.
Learned standing counsel appearing on behalf of the respondent Nos. 1 to 4 and Sri Sanjay Chaturvedi, learned counsel appearing on behalf of respondent No.5 very fairly state that the decision in this regard shall be taken by the first respondent, within such time as may be directed by this Court.
Accordingly, the instant petition is disposed of with liberty to the petitioners to approach the first respondent with a certified copy of this order and a fresh representation, and in which event, the same shall be decided by the first respondent by means of a speaking order within next three months.
