Heard learned counsel for the petitioner, learned Standing Counsel for the State-respondents and Sri Neeraj Chaurasiya, learned counsel representing the Basic Education Officer, Ambedkar Nagar.
This petition by the Committee of Management of non-government aided, Junior High School has been filed with the prayer to direct the District Basic Education Officer, Ambedkar Nagar to consider the prayer made by the petitioner-institution for according his permission to initiate the process of selection/appointment against one class-III post in the institution.
Sri Neeraj Chaurasiya, learned counsel for BSA has produced before the Court a Government Order dated 15.01.2019 issued by the Department of Basic Education whereby the cadre of Class-III and IV posts in the non-government recognized institution have been declared to be dying cadre.
Be that as it may, this petition is disposed of finally with the direction to the Basic Education Officer concerned to take decision on the application said to have been preferred by the petitioner on 25.07.2019, which has been annexed as annexure no.3 to the writ petition strictly in accordance with law, rules and the extant government orders and policies, within a period of two months from the date of production of a certified copy of this order. The decision so taken by the Basic Education Officer shall be communicated to the petitioner.
