It is reflected from the records, as has been set out and also evident from the order passed in Civil Misc. Writ Petition No.71621 of 2010, that there has been large scale misappropriation of money meant for G.P.F. purposes. This Court has already taken serious view of the matter in the aforesaid writ petition and the C.B.I. has been asked to investigate the matter and submit report. It has been informed that the matter is still pending with Hon'ble Mr. Justice Sudhir Agrawal.
In the present case on the same set of allegations, the Committee of Management of the institution has been superseded and the District Inspector of School has been asked to function as Authorized Controller. The petitioners are contending that the District Inspector of Schools is making large scale manipulations, whereas he had been instrumental in the G.P.F. scam. Petitioners have stated that as far as institution and its employees are concerned, they are not party to the proceeding in question and certain group of persons are involved in the scam for their personal advantage. This Bench without expressing its mind as to the merit or demerit of the case, for the simple reason that the investigation has been taken over by the C.B.I. and one particular Bench is seized of the matter, it would be much more appropriate that this writ petition be also listed along with writ petition No.71621 of 2010 on the date fixed in the aforesaid case.
On account of mere pendency of the writ petitions, the petitioners are not prevented from approaching the Director of Education for change of Prabandh Sanchalak.
