Learned counsel for the petitioners submitted that as per the impugned order, the date of hearing was fixed on 16.4.2000, 18.5.2010 and 26.5.2010 on which date all the parties appeared. Thereafter the Joint Director vide letter dated 24.6.2010 has sought certain informations from the District Inspector of Schools, Bulandshahar on which the District Inspector of Schools, Bulandshahar has given report dated 11.8.2010, which is also referred in the impugned order. In the impugned order, there is also a reference of hearing on 28.8.2010. According to the petitioners, no hearing took place before the Regional Level Committee on 28.8.2010. The order has been passed in violation of principle of natural justice.
No counter affidavit has been filed by the learned Standing Counsel appearing on behalf of respondent nos. 1 to 3. Let the learned Standing Counsel may file counter affidavit and produce the record of the Regional Level Committee before this Court on the date fixed.
List on 12.3.2012. Till the next date of listing, interim order shall continue.
