(Oral) Heard learned counsel for the petitioner.
In compliance of the earlier order passed by this Court, instructions have been received from the office of District Basic Education Officer, Raebareli, which has been produced by the learned Standing Counsel. The same is taken on record.
It is apparent from the the said instructions, that after this Court passed the order dated 30.4.2019, the institution in question is still running under single hand operation and teachers are being paid salary, although two recommendations have been made by the office of the District Basic Education Officer, Raebareli in favour of withdrawal of the order appointing Authorized Controller. No withdrawal order has been passed at all by the Deputy Director of Basic Education, Lucknow. The District Basic Education Officer, Raebareli in his instructions has stated that the finance and accounts officer in the office of District Basic Education Officer, Raebareli is ensuring payment of salary to all teachers regularly under single hand operation. However, no Authorized Controller has either been appointed after expiry of six months period nor any orders have been passed on repeated recommendations made in this regard by the District Basic Education Officer, Raebareli.
Since the time of six months expired for appointing Authorized Controller and the last such extension was granted only on 5.5.2018, this writ petition is disposed of with a direction to the petitioner to make a representation to the Director, Basic Education and the Regional Deputy Director of Basic Education, Lucknow Region, Lucknow to reinstate the management of the institution. In the said representation, the management shall also file documentary evidence of continued existence of the Committee of Management and its holding of elections in time and also submit list of members of the Society for the year 2019-20. In case such representation is made by the petitioner within four weeks from today, the Director, Basic Education shall summon a report from the Deputy Director of Basic Education, Lucknow and pass appropriate orders within six weeks thereafter.
