Heard Sri Vashistha Tiwari, learned counsel for the petitioners and Sri M.A.Ausaf and Sri K.S.Kushwaha, learned counsel appearing for respondent no.4. Learned Standing Counsel represents respondents no.1,2 and 3.
By means of this writ petition the petitioners have come up to this Court raising a grievance with regard to the institution being brought under the grant-in-aid list.
Learned counsel for the petitioners submits that the petitioners' institution has been taken under the grant-in-aid list whereas Sri K.S.Kushwaha, learned counsel appearing for respondent no.4 submits that the institution of the respondent no.4 was brought under the grant-in-aid list and not the institution of the petitioners.
Sri Kushwaha, learned counsel has relied upon the registration certificate issued by the Registrar, Societies and submitted that both the registrations are different in number. It is further submitted by Sri Kushwaha, learned counsel that the registration of the petitioners' society is from 2.9.1994 whereas the institution of respondent no.4 was registered on 20.1.1981. The institution of respondent no.4 having been in the grant in aid list in the year 1989, therefore, on such date the petitioners' institution was not even registered. As such, it cannot be held that the petitioners' institution has been brought under the grant-in-aid list.
Both the parties are claiming grant-in-aid on the basis of similarity of the name of both the institutions.
The matter requires consideration.
The respondents may file counter affidavit within one month.
