The authorized controller was appointed to manage the affairs of the petitioner-Institution. The elections to the committee of management of the Institution were on 22.05.2018. The elections were last held to the committee of management of the Institution in the year 2017.
The only prayer made by the learned counsel for the petitioner is that the elections to the committee of management of the Institution may be held within a stipulated period of time.
The matter is remitted to the respondent No.3-The Joint Director of Education, Saharanpur Division, Saharanpur.
A writ of mandamus is issued commanding the respondent No.3-The Joint Director of Education, Saharanpur Division, Saharanpur to enquire into the fact whether the elections to the committee of management of the Institution are due or not. In case the elections are due but have not been held, the Joint Director of Education shall pass appropriate orders for conducting the said elections. The Joint Director of Education before passing any order shall hear all necessary parties. The exercise shall be completed, preferably, within a period of four months from the date of receipt of a certified copy of this order.
With the aforesaid direction, the writ petition is finally disposed off.
