The only prayer made in this petition is to direct the respondents to consider and pass appropriate orders upon the application of petitioner Committee of Management to grant permission to fill up the lone post of class IV employee in the institution.
It is stated that in terms of the provisions of the U.P. Recognized Basic Schools (Junior High Schools) (Recruitment and Conditions of Services of Ministerial Staffs and Group 'D' Employees) Rules, 1984, such appointment can be made only upon approval of the authority concerned with its nominee as member of the selection committee. In respect of such grievance, petitioner has approached the authority concerned, but no decision has yet been taken. Hence, this petition.
Sri Vikram Bahadur Singh, learned counsel for the District Basic Education Officer concerned submits that the grievance of the petitioner shall be examined by the authority concerned, in accordance with law.
Without entering into merits of the case and issues on facts, it would be appropriate to dispose of this writ petition with the direction upon respondent no.2 to accord consideration to petitioner's claim, noticed above, in accordance with law, by means of a reasoned order to be passed, within a period of two months from the date of presentation of certified copy of this order.
Writ petition is accordingly disposed of.
