Heard learned counsel for the petitioners and learned Standing Counsel for the respondents.
The Present writ petition under Article 226 of the Constitution of India has been filed for issuing a writ of mandamus commanding the respondents to consider the case of the petitioner and make Petitioner's Institution as examination centre for conducting the U.P. Board Examination 2020.
It is contended by learned counsel for the petitioners that the Petitioner's Institution applied for the examination centre for conducting the High School and Intermediate Examination for the year 2020 and fulfilled all the criteria as laid down in the Government Order dated 16.10.2019, but in the final list published by the respondents, name of the Petitioner's Institution did not find place. The petitioner in this regard has filed an objection/representation on 13.11.2019 before the DIOS, Sant Kabir Nagar, but the grievance of the petitioner needs to be examined by Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad.
In view of the aforesaid, the present writ petition is disposed of, by providing that the petitioner may make a representation, ventilating all his grievances supported by such documents as may be advised, before the respondent no.3 Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad within a week's from today alongwith a certified copy of this order. On such representation being made, the Secretary, Madhyamik Shiksha Parishad,U.P., Allahabad shall consider and decide the same in accordance with law by means of a reasoned and speaking order, preferably within three weeks from the date the representation is made.
