Heard Sri S.K. Mishra, learned counsel for the petitioners and Sri Prabhakar Awasthi, Advocate as well as Aishwarya Pratap Singh Advocate appearing on behalf of respondent no. 6 as well as learned Standing counsel for the State-respondents.
The present writ petition has been filed with the following reliefs:-
" I. Issue a writ, order or direction in the nature of mandamus directing the respondent nos.4- District Inspector of Schools to not make any approval of the alleged meeting held on 15.12.2019, in which the Hanumant Singh elected as Manager of Committee of Management of Chaudhary Shivsahay Singh, Intermediate College, Jairampur District- Fatehpur.
II. Issue a writ, order or direction in the nature of mandamus directing the respondent no. 3 Joint Director of Education Prayagraj, Region Prayagraj to decide the representation dated 12.12.2019 (Annexure No.14 to this writ petition), within stipulated period of as may be fixed by this Hon'ble Court.
III. Issue a writ, order or direction in the nature of mandamus directing the respondent no.5- Assistant Registrar, Firm Societies and Chits, Prayagraj District- Prayagraj to decide the dispute of the alleged Committee of Management of Chaudhary Shivsahay Singh, Intermediate College, Jairampur District- Fatehpur, within stipulated period as fixed by this Hon'ble Court.
IV. Issue any other writ, order or direction in the nature of writs, as this Hon'ble Court may deem fit and proper to meet ends of justice."
So far as the first prayer is concerned Sri Prabhakar Awasthi, learned counsel for the respondent no.5 has produced the copy of the order dated 18.12.2019 passed by the DIOS, Fatehpur, whereby the election held by respondent no.6 Committee was approved and the signature of Hanumant Singh has been attested as a Manager of the Committee, the first relief claimed by the petitioner has become redundant.
So far as the second and third prayer is concerned, the petitioners have failed to indicate that under what provisions of law, filed their representation before the Joint Director of Education Prayagraj, Region Prayagraj as well as Assistant Registrar, Firm Societies and Chits, Prayagraj District- Prayagraj even the petitioners have failed to indicates their status in the writ petition, only this much is stated that the petitioners are life members of the Society but no documents in this regard has been been appended.
In the aforesaid facts and circumstances, this Court is not inclined to interfere in the matter under Article 226 of Constitution of India.
The writ petition filed by the petitioners lacks merit and is accordingly dismissed.
