Heard learned counsel for the petitioner as well as learned Standing Counsel appearing for the respondents and have perused the record.
From perusal of the array of parties it appears that name of Sri Pradeep Singh has incorrectly been shown from the side of the respondents.
Present petition has been filed with a prayer to direct the respondents to consider the petitioners Institution for providing recurring Gran-in-aid in pursuance of recommendation/report send by the District Social Welfare, Officer, District- Mau to the Director Social Welfare, Department, Anubhag-2, U.P. at Lucknow.
At the very outset, learned counsel for the petitioner and the learned Standing Counsel agree that the controversy involved in the present writ petition is fully covered by a decision of this Court dated 11.2.2020 passed in Writ Petition (C) No. 5016 of 2020 (C/M Jai Mata Adishakti Ambedkar Vidyalay And 2 Others Vs. State of U.P. And 5 Others).
The said judgement dated 11.2.2020 is quoted hereinunder:-
"Petitioner institution is a recognised primary institution which is imparting education to students of socially and economically backward sections. Pursuant to a Government Order issued on 1.10.2012 as also subsequent Government Order dated 23.11.2012, the petitioner institution has applied for sanction of recurring grant and a report was submitted in that regard by the District Magistrate, Mau to the Principal Secretary, Samaj Kalyan on 14.11.2013. In the enclosed chart to this letter, the details of petitioner institution appears at Sl. No. 9. Grievance is that though substantial period has expired but till date the State Government has not taken any decision in the matter relating to sanction of recurring grant to the institution concerned in terms of the policy framed by the State Government and hence, this petition.
Learned Standing Counsel states that an appropriate examination would be made at the level of the Director and necessary orders would be passed.
In the facts and circumstances of the case, it would be appropriate to permit the petitioner to represent his grievance before the respondent no. 2, alongwith certified copy of this order, annexing all materials in support of its claim. The Director shall get the facts verified and in case it is found that the petitioner's claim is liable to be considered, he shall transmit papers to respondent no.1 within a further period of six week thereafter. An appropriate decision at the level of the respondent no. 1 would be taken within a further period of two months, thereafter. Writ petition stands disposed of accordingly. "
Consequently, the present petition is also disposed of in terms of the aforesaid judgement dated 11.2.2020 as quoted above.
