Heard learned counsel for the petitioner, learned Standing Counsel and Sri Jagdish Prasad Chaurasiya, holding brief of Sri A.C. Srivastava for the respondents.
Controversy raised in the present petition stands adjudicated by this Court under an order dated 31.1.2017 passed in C/M, Nehru Kissan Vidyalaya Jr. High School Vs. State of U.P. and others, reported in 2017 (3) ADJ 503.
In view of the reasons assigned therein, the order impugned dated 13.2.2018 cannot be sustained and is quashed. The authority concerned is directed to consider the matter afresh, keeping in view the observations made in C/M, Nehru Kissan Vidyalaya Jr. High School (supra).
Writ petition is, accordingly, allowed.
