Petitioner has made following reliefs in the writ petition:-
"To issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to consider for grant of recognition of starting B.Ed course of 100 intake to Shri Bhagwan Mahaveer Post Graduate College, Pawanagar, Fazilnagar, Kushinagar, within the period to be stipulated by this Hon'ble Court.
(ii) To issue a writ, order or direction in the nature of mandamus commanding the respondent no. 2 to consider and pass appropriate order on the representation made by the petitioner no. 2 for grant of recognition of starting B.Ed course of 100 intake of Shri Bhagwan Mahaveer Post Graduate College, Pawanagar, Fazilnagar, Kushinagar, within the period to be stipulated by this Hon'ble Court."
The petitioner has approached this Court after a delay of five years from the date the application for grant of recognition was made. The delay has not been explained satisfactorily. Moreover, Sri Dhananjay Awasthi, learned counsel for the respondent no. 2 submits that there have been material changes in the bye-laws for affiliation. The application of the year 2013 cannot be entertained.
In such view of the matter the prayer made by the petitioner in the instant writ petition cannot be granted.
Faced with the aforesaid, Sri Raj Mohan Yadav, learned counsel holding brief of Sri Ramesh Chandra Dwivedi, learned counsel for the petitioners recasts his relief. The only prayer made is that the petitioner may be permitted to apply a fresh application for recognition.
It is open to the petitioner to apply for recognition of the B.Ed Course in accordance with law.
The writ petition is disposed of.
