The petitioner seeks a direction on the respondent to consider the approval of the Assistant Teachers in the institution namely 'Baba Raghunandan Das Sanskrit Mahavidhyalaya, Vaishno Nagar, Kanpur Nagar.
It is contended by the committee of management that there are four sanctioned posts of the Assistant Teachers in the institution. One post fell vacant due to retirement of a regular teacher on 30.6.2011. The petitioner, the committee of management, after intimating the concerned authority, has made the selection following the procedure prescribed under the law and has forwarded the papers for approval in the office of District Inspector of Schools, Kanpur Nagar (the DIOS).
The grievance of the petitioner is that no decision has been taken by the office of the DIOS to date.
Keeping the writ petition pending would not serve any purpose. Therefore, with the consent of the parties, the writ petition is finally disposed of in terms of the Rules of the Court.
Taking into consideration all the facts and circumstances of the case, in my view the end of justice would be served in case a direction is issued upon the DIOS (Respondent no. 3) to consider the cause of the petitioner and pass appropriate orders in accordance with law after hearing him and the concerned parties, if any, expeditiously, preferably, within a period of four months from the date of communication of this order before respondent no. 3. It is made clear that this Court has not expressed adjudicated the matter on merit. The authority shall consider the matter and pass appropriate orders in accordance with law.
With the aforesaid directions, the writ petition is disposed of.
