Committee of Management of the institution is before this Court with the grievance that it had made an application to the Inspector for grant of permission to fill the post of Assistant Clerk in the institution, but no orders are being passed. Reliance is placed upon a decision of this Court in Abhishek Tripathi vs. State of U.P. and others reported in 2015 (4) ADJ 270 in order to contend that once the vacancy has been determined under the order of the State Government all relevant issues can be examined at the stage of grant of approval. Submission is that the authorities have not been examined the matter in correct perspective as was expected from them.
Learned Standing Counsel submits that the authority concerned shall examine the matter, in accordance with law.
In view of the above, this writ petition stands disposed of with a direction upon the respondent no.3 to accord consideration to petitioner's claim, as noticed above, after seeking appropriate permission from the Director concerned, in accordance with law, within a period of two months from the date of presentation of certified copy of this order.
