Judgment:
SC for This Civil Miscellaneous Second Appeal (CMSA) is filed against Order, dated 29-03-2014, in Tax Appeal No.158 of 2011, on the file of the Court of the learned Principal Senior Civil Judge, Visakhapatnam (for short ‘the lower Court’).
I have heard Mr.B.Vijaysen Reddy, learned Counsel for the appellant, and Mr.S.Lakshminarayana Reddy, learned Standing Counsel for Greater Visakhapatnam Municipal Corporation (GVMC) i.e., the respondent herein.
Both the learned Counsel have conceded that the subject matter of this CMSA is similar to that of CMSA.No.19 of 2014, which was disposed of by this Court today i.e., on 07-08-2014. By the said Order, this Court has directed the Commissioner of the respondent to hear the Tax Appeal afresh and dispose of the same on merits subject to the appellant therein depositing the enhanced tax and filing proof of such deposit within four weeks.
Mr.B.Vijaysen Reddy, learned Counsel for the appellant, urged that this CMSA also be disposed of on the very same terms.
Accordingly, this Civil Miscellaneous Second Appeal is disposed of in terms of Order, dated 07- 08-2014, in CMSA.No.19 of 2014, with the direction that the reasons and directions contained therein shall form part of this order.
As a sequel, CMSAMP.No.16 of 2014, filed by the appellant for interim relief, is disposed of as infructuous.
