The Court made the following:
ORDER:
This Civil Revision Petition arises out of order, dated 24.01.2014, in R.A.No.9 of 2013 on the file of the learned Principal Senior Civil Judge, Ranga Reddy District at L.B.Nagar.
I have heard Sri M.V.L.Srinivas, learned counsel for the petitioner and perused the record.
One of the main pleas raised by the petitioner in the above-mentioned appeal is that there was no proper service of notice on him in RA.No.9 of 2013.
I, therefore, feel it appropriate that the petitioner files an application before the lower appellate Court for recalling order, dated 24.01.2014, in RA.No.9 of 2013. If such application is filed, the learned Principal Senior Civil Judge, Ranga Reddy District shall enquire into the same and if the petitioner is able to satisfy that no notice in the appeal was served on him, she shall recall order, dated 24.01.2014 and dispose of the appeal on merits afresh after hearing both parties. Conversely, if it is found that the notice was served on the petitioner, the learned Principal Senior Civil Judge, Ranga Reddy District shall dismiss the application of the petitioner.
The Civil Revision Petition is, accordingly, disposed of.
As a sequel to disposal of the Civil Revision Petition, CRPMP.No.1341 of 2014 is dismissed as infructuous.
