JUDGMENT / ORDER

This petition has been filed to quash the FIR in Crime No.1675 of 2016 pending on the file of the first respondent police.
2. The petitioners are accused in Crime No.1675 of 2016 for the offence under Section 304-A IPC. Subsequently, the matter was investigated and final report was also filed. Then, the matter was taken on file in C.C.No.104 of 2017 on the file of the learned Judicial Magistrate, Alandur and the same was pending. Now, the accused in this case paid a sum of Rs.4,50,000/-(Rupees Four Lakhs Fifty thousands only) to the defacto complainant and another dependent of the deceased. Today, both the accused and defacto complainant are present before this Court and they have filed a joint memorandum of compromise stating that the defact complainant received money from the accused and she is not willing to proceed with the criminal case further.
3. Heard the learned counsel appearing for the petitioner, learned Additional Public Prosecutor for State, learned counsel appearing for the second respondent/defacto complainant and perused the materials available on record.
4. Taking into consideration the fact that the defacto complainant is not willing to proceed with the criminal case further and even if the case is permitted to continue there is no chance for conviction. Now the parties wanted to withdraw the case on the ground that the accused paid a compensation to the defacto complainant and another dependent of the deceased, the present complaint has to be quashed.
5. In the result, the criminal original Petition is allowed. The proceedings in Crime No.1675 of 2016 pending on the file of the first respondent is quashed.
