THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR PUBLIC INTEREST LITIGATION No. 223 of 2014 ORDER: (Per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) In our considered view, the grievance and the allegations made by the petitioner in the writ petition do not involve any public interest. As it appears from the writ petition that the unofficial respondent is alleged to have been making illegal construction in the Mosque premises restraining the Muslim from performing the prayers, we think that it is not the duty of the Government to protect the private land and it is for the person aggrieved to approach the appropriate civil Court for taking measures.
The writ petition is accordingly dismissed.
Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
