THE HON’BLE SRI JUSTICE R.KANTHA RAO WRIT PETITION NO.22143 OF 2014 ORDER:
Heard the learned counsel appearing for the petitioner and Sri Deepak Misra, learned standing counsel for Co-operative Societies appearing for the respondents.
This writ petition is filed seeking to issue a writ of mandamus, declaring the action of the respondents in not considering the representation of the petitioner dated 16- 06-2012 as arbitrary, illegal and in violation of the principles of natural justice and also violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to consider the representation of the petitioner dated 16-6-2012 for regularization of his services in 2nd respondent bank.
The learned counsel appearing for the petitioner submits that the petitioner was appointed as a Messenger in District Co-operative Central Bank Limited, Srikakulam, vide proceedings in R.C.No.Estt/F5/2009-10, dated 1-8- 2009. He submitted a representation dated 16-6-2012 to the first respondent seeking regularization of his services. He is being paid salary of Rs.155/- per day, which is not sufficient to maintain his family. There are regular vacancies available in the bank at present and he requested the respondents to regularize his services.
In view of the submissions made by the learned counsel appearing for the petitioner, the respondents are directed to consider and dispose of the representation of the petitioner dated 16-6-2012 seeking regularization of his services as per rules, within a period of four weeks from the date of receipt of a copy of this order.
The writ petition is disposed of accordingly at the stage of admission. No order as to costs. The Miscellaneous Petitions pending if any shall stand closed.
