As per prosecution case, on 30.09.2009 at 9.30 a.m. a large crowd under the leadership of Mahendra Pal Dixit and Ram Gopal Dixit assembled at the railway station, pelted stones and set the boggies of Mahananda Express afire.
It is submitted by the learned counsel for the applicant that there are general allegations in the FIR and no specific role has been assigned to the applicant except the leaders.
Learned AGA opposed the application for bail.
Having regard to all the facts and circumstances of the case, but without expressing any opinion about merit of the case, the applicant may be released on bail. It is worthwhile to mention that other co-accused also have been enlarged on bail by other Benches of this Court.
Let the applicant Bunty @ Baniya son of Nathu Ram @ Natha Ram be released on bail in case crime no. 155 of 2009 under sections 147, 148, 332, 353, 336, 427, 436, 307, 504 IPC, 7 Criminal Law Amendment Act and 5/6 Prevention of Public Property Damage Act and 151/152 Railway Act, P.S G.R.P. Aligarh (Hathras Junction) Aligarh on his executing a personal bond of Rs 40,000/- and furnishing two sureties each in the like amount to the satisfaction of the court concerned.
