This appeal has been preferred against the orders dated 1.9.2018 and 11.9.2018 issuing a non bailable warrant and process under Section 83 Cr.P.C. passed by Special Judge SC/ST Act, Agra.
Learned counsel for the appellant contended that on the date fixed i.e. on 1.9.2018 appellant could not appear before the trial court. Accordingly impugned order has been passed. The impugned order has been passed due to non appearance of the appellant before the trial court. According, I find no infirmity in the impugned order passed by the trial court.
In result the appeal is dismissed.
However, if the appellant surrenders and applies for bail before the trial court, the same shall be decided expeditiously.
For a period of 30 days process under Section 83 of Cr.P.C. shall not be executed.
